Asistencia del procesado. El procesado privado de libertad debe estar presente en la audiencia pública, salvo que se compruebe enfermedad o causa grave que impida su concurrencia. La ausencia del procesado que no estuviere privado de libertad no impedirá la celebración de la audiencia.
