En cualquier estado del proceso en que el Juez advierta que existe alguna de las causales previstas en los artículos anteriores, decretará la nulidad de lo actuado desde que se presentó la causal, y ordenará que se reponga el proceso para que se subsane el defecto, salvo que se tratare de ilegitimidad de la personería en el querellante.
