º . El área que se pretenda excluir de la inicialmente declarada como zona franca, deberá tener las siguientes características

Su extensión superficiaria no podrá exceder del treinta por ciento (30%) del área inicialmente declarada como zona franca.

No podrá afectar el área mínima exigida por la ley.

En el área excluida no se debe haber adelantado ningún tipo de desarrollo y debe encontrarse libre de compromisos con terceros incluyendo eventuales usuarios desarrolladores o industriales de bienes o servicios, salvo que la reducción obedezca a caso fortuito o fuerza mayor.
