La persona de las designadas en el artículo 1279 del Código Civil que desee se tomen respecto de los bienes de una sucesión no sólo las medidas indicadas en el parágrafo precedente, sino el secuestro preventivo de los bienes relictos, o en lugar de ellas el solo secuestro, puede demandarlo al Juez del Circuito o Municipal del lugar en donde se hallen los bienes, presentando las pruebas de que trata el artículo 894.
