Art. 413. En los asuntos de que trata el artículo anterior la Corte resolverá como Tribunal de derecho en cuanto a la aplicación de la pena siéndole prohibido varias la calificación hecha por el Consejo de Guerra respectivo de la culpabilidad de inocencia del acusado.

Aclarase así el artículo 1539 del Código Militar.
