En los casos del artículo 5.° de la Ley 38 de 1877, sobre minas, el nombramiento de perito tercero será hecho por el Gobernador del Departamento, quien deberá hacerlo en Ingeniero ó persona competente en la materia.

Dada en Bogotá, á diez y seis de Noviembre de mil ochocientos noventa y cuatro.
