A partir del 1° de enero de 2010, el subsidio de alimentación para los servidores que perciban una asignación básica mensual no superior a un millón ciento setenta y seis mil setecientos cuarenta y cuatro pesos ($1.176.744) m/cte., será de: cuarenta y un mil seiscientos doce pesos ($41.612) m/cte., pagaderos mensualmente por la entidad correspondiente. No se tendrá derecho a este subsidio durante el tiempo que el empleado disfrute de vacaciones, se encuentre en uso de licencia, suspendido en el ejercicio del cargo, o cuando la entidad suministre la alimentación.
