De .las tres colonias agrícolas que se establecen por el artículo anterior, una se destinará para recibir a los condenados, que como los señalados en la Ley 105 de 1922, deben estar sometidos a un régimen especial. Las otras dos se destinarán para los que merezcan un régimen de menor severidad, de acuerdo con lo que se dispone en este capítulo. Las colonias agrícolas penales se establecerán de preferencia en terrenos baldíos y en ellos se organizarán especialmente trabajos agrícolas.
