Cuando a un empleado le sea conferida comisión oficial dentro del territorio nacional y fuera de la sede habitual de trabajo, tendrá derecho al pago de viáticos en proporción a su asignación mensual y al lugar donde deba desempeñarse, con arreglo a las escalas contenidas en el Decreto 559 de 1969, y disposiciones que lo adicionen o reformen. Igualmente tendrá derecho a los gastos de viaje y de transporte que demande el cumplimiento de la comisión.
