Art. 16 En el caso de que el auto de proceder fuere apelado, se dará traslado en la segunda instancia al respectivo Agente del Ministerio Público por tres días y evacuando el traslado se fijará en lista el negocio por otros tres días para que la parte del acusado alegue lo que estime por conveniente dentro de los cinco días siguientes la Gobernación dictará la providencia á que haya lugar, en estos casos el enjuiciado permanecerá en prisión mientras no sea revocado el auto recurrido.

Parágrafo

Si el procesado no pudiere nombrar defensor, se le nombrará uno oportunamente, en esta segunda instancia.
