º. El artículo 40 del Decreto 1890 de 1999, quedará así: "Artículo 40. El Instituto Nacional Penitenciario y Carcelario, Inpec, no cederá ningún bien inmueble al Ministerio de Justicia y del Derecho. Las obras que el Fondo de Infraestructura Carcelaria, FIC, del Ministerio de Justicia y del Derecho ejecute en desarrollo de sus funciones, una vez recibidas a satisfacción por esta entidad, pasarán por ministerio de la ley al Inpec.

Parágrafo

Sin perjuicio de lo dispuesto en este artículo, el Inpec cederá al Ministerio de Justicia y del Derecho los inmuebles que conforme a estudios técnicos realizados por el FIC, sean necesarios para la construcción de nuevos proyectos de infraestructura carcelaria",
