ARTICULO 5 . DEBIDO PROCESO. Todo el personal uniformado deberá ser investigado conforme a las leyes sustantivas y procesales preexistentes a la falta disciplinaria que se le atribuya, ante funcionario competente previamente establecido y observando las garantías contempladas en la Constitución Política y en el procedimiento señalado en este decreto.
