ARTICULO 262. Retención prestaciones. El Ministerio de Defensa Nacional podrá retener las prestaciones sociales de los Oficiales y Suboficiales de las Fuerzas Militares, cuando éstos se hallen sindicados de delitos contra los bienes del Estado previstos en el Código Penal Militar, hasta cuando se produzca sentencia definitiva. En caso de condena, el valor de las prestaciones sociales retenidas se tomará para cubrir el monto de los daños y perjuicios que se hayan causado al Estado.
