º. Se halla en estado de quiebra todo comerciante que sobresee en el pago corriente de sus obligaciones. La muerte del deudor o su retiro del comercio no impiden la declaración y procedimiento de quiebra cuando ha fallecido o se ha retirado en estado de cesación de pagos. La declaración no podrá pedirse sino dentro del año siguiente a la muerte o retiro.
