Los Consejos de Guerra Verbales se integrarán, así: Un Presidente, tres Vocales, un Fiscal, un Asesor Jurídico, y un Secretario. El Presidente, los Vocales y el Fiscal deben ser Oficiales en servicio activo o en retiro, superiores en grado o antigüedad al sindicado, cuando este sea militar y cuando se trate de juzgar a Magistrados o Fiscales del Tribunal Superior Militar, serán Oficiales superiores. El Secretario será un Oficial en servicio activo, en los casos en que se juzgue a personal de Oficiales, o un militar de cualquier graduación, también en servicio activo, en los demás casos. Quien convoque el Consejo, o el funcionario de instrucción o el Presidente, pueden ordenar la captura del sindicado o sindicados.
