° La Dirección General de Prisiones también podrá enviar a la Isla Prisión de Gorgona los sindicados de delitos de homicidio agravado, .de competencia de la justicia penal militar, cuando contra ellos se dicten sentencia condenatoria de primera instancia, con el solo requisito de que así lo solicite el juez del conocimiento.
