QUIENES CONOCEN. De los impedimentos y recusaciones de los jueces de primera instancia conoce el Tribunal Superior Militar; de los jueces de instrucción penal militar, fiscales, auditores de guerra y secretarios, el respectivo juez de primera instancia; del presidente y demás integrantes del consejo verbal de guerra, quien lo convoque. Los funcionarios competentes resolverán de plano, y contra la decisión que pronuncien no procede recurso alguno.
