INCUMPLIMIENTO DE LAS OBLIGACIONES. Al interno que incumpla las obligaciones previstas en el programa de institución abierta, de confianza, libertad o franquicia preparatorias, se le revocará el beneficio y deberá cumplir el resto de la condena sin derecho a libertad condicional.

En caso de condenados que se encuentren sindicados o condenados por hechos punibles cometidos durante el tiempo de reclusión no podrán gozar de los beneficios de establecimiento abierto.

LEGISLACIÓN ANTERIOR

ARTICULO 150. INCUMPLIMIENTO DE LAS OBLIGACIONES. Al interno que incumpla las obligaciones previstas en el programa de institución abierta, de confianza, libertad o franquicia preparatorias, se le revocará el beneficio y deberá cumplir el resto de la condena sin derecho a libertad condicional.

En caso de reincidentes, o de condenados por delitos de conocimiento de los jueces o fiscales regionales o del tribunal nacional no podrá otorgarse ninguno de los beneficios de establecimiento abierto.
