° En el caso de que el nombrado Habilitado para lugar distinto de la capital de la República, no tome posesión oportunamente, ó por cualquier motivo no pueda ejercer sus funciones el Prefecto respectivo designará el individuo que debe ejercerías en interinidad. De este hecho dará aviso inmediato dicho funcionario al Ministerio de Guerra.
