Cuando un agente sea sorprendido en flagrancia causando daños al medio ambiente, a los recursos naturales o violando disposición que favorecen el medio ambiente sin que medie ninguna permisión de las autoridades ambientales competentes, la autoridad ambiental impondrá medidas cautelares que garanticen la presencia del agente durante el proceso sancionatorio.
