ARTICULO 74 . DECLARATORIA DE OFICIO. Cuando el funcionario advierta que existen algunas de las causales previstas en el artículo anterior, decretará la nulidad de lo actuado desde cuando se presentó la causal, y ordenará que se reponga la actuación que depende del acto nulo para que se subsane lo afectado. Este auto deberá ser notificado al encartado.
