Cuando las circunstancias personales del responsable no revelen mayor peligrosidad y el valor de lo hurtado o robado sea inferior a mil pesos, siempre que el hecho no haya ocasionado a la víctima grave daño atendida su situación económica, la pena establecida en los artículos 397, 402 y 404 del Código Penal, podrá reducirse hasta la mitad.
