Se adjudicarán gratuitamente a los concesionarios 250,000 hectaras de tierras baldías, que serán adjudicadas directamente por el Poder Ejecutivo nacional. Las tierras baldías situadas en las costas marítimas, o a las orillas del canal o de los rios, se distribuirán en lotes alternados entre el Gobierno i los concesionarios. La mensura de ellos será costeada por los concesionarios, i en ella intervendrán comisionados del Gobierno.
