Cuando en el personal de servicio activo no se encuentre el suficiente para integrar el respectivo Tribunal, el Juez, de acuerdo con la lista que le envíe el Ministerio de Guerra, debe llevar a cabo el sorteo, tomándolo del personal en retiro.
