Las corporaciones y funcionarios a quienes compete proveer cargos por concurso podrán prescindir de tal requisito para hacer el nombramiento en propiedad, cuando no se haya celebrado concurso y cuando declarado desierto, no se celebre uno nuevo dentro del año siguiente o el que se realice entonces quede también desierto. En tal caso no se producirá ascenso en la Carrera, ni permanencia más allá del período.
