Si el detenido o preso que se ha fugado se presentare luégo voluntariamente a la autoridad, no incurrirá en aumento alguno de pena por razón de la fuga misma, pero será siempre responsable de las violencias de que se hubiere servido cuando sean punibles por sí mismas.
