Artículo Quinto. El reo que no constituya la acusación que se le exija dentro del termino fijado, podrá ser arrestado hasta que la otorgue, y, si permaneciere en arresto por tal motivo mas de treinta (30) días, se le conmutará la caución por confinamiento a cien (100) kilómetros a lo menos, durante un termino de tres (3) meses a un (1) año, bajo la estricta vigilancia del Jefe de Policía del lugar del confinamiento.
