ARTICULO 318. Retractación. No habrá lugar a punibilidad si el autor o partícipe de cualquiera de los delitos previstos en este Título, se retractare antes de proferirse sentencia de primera o única instancia con el consentimiento del ofendido, siempre que la publicación de la retractación se haga a costa del responsable, se cumpla en el mismo medio y con las mismas características en que se difundió la imputación o en el que señale el juez, en los demás casos. No se podrá iniciar acción penal, si la retractación o rectificación se hace pública antes de que el ofendido formule la respectiva denuncia.
