º . Naturaleza. Los fondos departamentales, distritales y municipales de pensiones públicas, serán cuentas especiales, sin personería jurídica, adscritas a la respectiva entidad territorial o a una distinta según la conveniencia, cuyos recursos se administrarán mediante encargo fiduciario.

Parágrafo

En aquellos casos en los cuales no se pueda efectuar un encargo fiduciario, se podrán asignar las funciones para la administración de los recursos del fondo a cualquier entidad perteneciente al respectivo ente territorial.
