Recibido el expediente por el Juez de primera instancia, procede a su estudio. Si de este estudio encuentra que el funcionario instructor dejó de practicar algunas diligencias, las practica o comisiona al mismo o a otro instructor para que lo haga. Realizadas las diligencias o no habiendo diligencias que practicar el Juez dictará un auto para declarar cerrada la investigación y ordenará traslado al Fiscal por tres días para que emita concepto de fondo.
