Para que la acción del artículo 107 proceda se requiere:

1.-Que el que solicita la medida afirme que ha demandado o va a demandar a la persona contra la cual dicha medida se impetra, por actos o hechos jurídicos vinculados con el derecho de propiedad intelectual, los mismos que concretará en el libelo, y;

2.-Que preste caución suficiente para garantizar los perjuicios que el secuestro pueda causar al demandado o presunto demandado o a terceros.
