°. El artículo 35 del Decreto 3930 de 2010, quedará así: "Artículo 35. Plan de Contingencia para el Manejo de Derrames de Hidrocarburos o Sustancias Nocivas. Los usuarios que exploren, exploten, manufacturen, refinen, transformen, procesen, transporten o almacenen hidrocarburos o sustancias nocivas para la salud y para los recursos hidrobiológicos, deberán estar provistos de un plan de contingencia y control de derrames, el cual deberá contar con la aprobación de la autoridad ambiental competente. Cuando el transporte comprenda la jurisdicción de más de una autoridad ambiental, le compete el Ministerio de Ambiente, Vivienda y Desarrollo Territorial definir la autoridad que debe aprobar el Plan de Contingencia".
