En el seguro de responsabilidad civil los damnificados tienen acción directa contra el asegurador. Para acreditar su derecho ante el asegurador de acuerdo con al artículo 1077, la víctima en ejercicio de la acción directa podrá en un solo proceso demostrar la responsabilidad del asegurado y demandar la indemnización del asegurador.
