La Asamblea del Departamento de Bolívar, al crear el Distrito a que se refiere el artículo anterior, dará aplicación al ordinal 5° y al parágrafo del artículo 1° de la Ley 49 de 1931 , sin perjuicio de lo establecido en el artículo 2° de dicha Ley, y examinará previamente si el nuevo Municipio puede reunir, con tal objeto, la mitad siquiera de las condiciones de que trata el ordinal 2° del artículo 1° precitado.
