Si se trata de calumnia o injuria contra los Jefes de naciones extranjeras o los Agentes Diplomáticas de las mismas, se requiere para proceder la queja de este último o la solicitud del Ministerio de Relaciones Exteriores, y la comprobación de que en la nación a que pertenece el ofendido, con excepción de la Ciudad del Vaticano, hay reciprocidad al respecto.
