Desde que se inicie algún sumario por delito militar el respectivo Comando nombrará el Oficial que lleve la voz fiscal cómo representante del Ministerio Público. El Fiscal será Oficial inferior para los asuntos de que conocen los encargados del detall y los Consejos de Guerra ordinarios. En los demás casos será Oficial superior, pero ningún Fiscal podrá ejercer el cargo sin haber prestado la promesa respectiva, como se prescribe para los funcionarios de instrucción.
