Art. 169. El fiador se somete implícitamente al Juez competente para conocer de las demandas contra el principal obligado. Pero en el contrato mismo puede establecerse expresamente otra cosa.

Si la prórroga de Jurisdicción fuere tácita, solo surte efectos entre las personas que han concurrido á otorgarla; mas no respecto de los fiadores ó codeudores.
