De conformidad con lo previsto en el artículo 10 del Decreto 2610 de 1979, se considera que existe certeza de la fecha de otorgamiento de una promesa de com praventa cuando ésta se señala en la Escritura Pública en Ia cual se ha celebrado, cuando ha sido presentada ante Notario o cuando se ha pagado el respectivo impuesto de timbre. En tales eventos se tienen por cierta la fecha de la escritura, Ia de autenticación de firmas y de no darse esta última circunstancia, la fecha de pago del impuesto de timbre.
