El Juez competente, una vez que haya practicado las diligencias por sí mismo, o haya recibido las levantadas por otro, debe dar aviso telegráfico de la defunción del extranjero al Ministerio de Relaciones Exteriores, el que ha de confirmar por correo, como lo dispone el artículo 190.
