Cesación del procedimiento. Cuando el Instituto Nacional de Vigilancia Medicamentos y Alimentos, Invima, o las Entidades Territoriales de Salud, con base en las diligencias practicadas comprueben plenamente que el hecho investigado no ha existido, que el presunto infractor no lo cometió, que las normas técnicosanitarias no lo consideran como infracción o que el procedimiento sancionatorio no podía iniciarse o proseguirse, procederán a dictar un auto que así lo declare y ordenará cesar todo procedimiento contra el presunto infractor. Este auto deberá notificarse personalmente al investigado.
